WHAT: Riviera Rescue ( www.rivierarescue.blogspot.com), CAPS, the Santa Cruz SPCA and Air France are conducting a historic rescue airlift of little death row dogs from Los Angeles animal shelters to Nice, France. This is the first such rescue ever to take place in France. The dogs were scheduled to be euthanized because of the American pet overpopulation crisis that is killing five million companion animals per year in our nation's shelter system. CAPS, the SDA, and the Mayor's office of Nice will welcome the L.A. dogs' arrival on the famous Promenade des Anglais in the heart of Nice along with French families who will be fostering the dogs until they find their adoptive homes.
This effort marks the internationalization of the Companion Animal Protection Society, which plans to expand its puppy mill and pet store investigations in Europe. CAPS claims pet stores all along the Riviera coastline are supplied by European puppy mills -- inhumane breeding factories. The Riviera Rescue airlift is a way to divert puppy mill sales on the Riviera and to promote adoption while saving lives.

Please write before Senate floor vote which could be as early as June 21. This bill is needed, not only in California, but also to set precedence in other states where it is a VERY Common requirement to rent an apartment to require new tenants to have their cats declawed on 2 or all 4 paws or debark their dogs. We are lucky in California that this bill is supported by the Apartment Association. If you are a landlord , please specify that in your letter. Everyone's letters and efforts will really help.
This bill was doing really well. It passed in the California Assembly with a 63-7 vote but last week the California Veterinary Medical Association raised their efforts to block the passing of this bill by using $$$$$ and lobbyists, The measure narrowly passed the Senate Judiciary Committee with a 3-2 vote, and could be voted on by the full Senate as early as the week of June 21. This Monday.
YOUR SUPPORT will be helpful because the California Veterinary Medical Association is lobbying very hard to kill the bill. CVMA is making the rounds of legislators¹ offices and making its views known to the Governor. It has also sent out an alert to its members stating that it is "strongly opposed" to the bill and urging its members to send letters of opposition to their state senators and to the Governor.
The CVMA is powerful because many legislators automatically support the position held by a trade or business association. Therefore, letters coming in from across the state strongly in support of the law will be necessary. Please inform as many people and rescue groups as possible.
The Office of Inspector General for USDA has released a scathing 69 page report for an audit and investigation conducted between 2006 and 2008. This audit/investigation was prompted by a May 2006 meeting between OIG officials, CAPS and Crowell & Moring attorneys, who provide pro bono counsel and lobbying to CAPS.
In 2006, the Office of Inspector General requested a meeting with CAPS. The OIG never meets with citizens or nonprofits (they turned down our first request), so this must have been based on our in-depth investigations of hundreds of puppy mills where we document Animal Welfare Act (AWA) violations and compare our findings to those of the USDA APHIS inspectors.
During a two hour meeting in May 2006, CAPS President Deborah Howard and CAPS attorneys/lobbyists Edward Green and David Ross met with two OIG officials. At this meeting, we discussed a long list of concerns and recommended necessary changes.
After that meeting, our lobbyists did not get a reply from OIG. The reason was that shortly after our meeting, the OIG commenced an investigation and audit, which ended in 2008.
All of the issues we covered in the meeting are in the report. In fact, the OIG report reads more like a CAPS investigation report (they included graphic photos, which is what we use in addition to undercover footage) than the usual dry government type OIG report. USDA officials, of course, are now saying they are going to make sweeping changes, and congressmen are calling for the same. CAPS has been meeting with congressional aides and USDA officials for more than eight years in an attempt to get oversight hearings and changes to the AWA.
CAPS will continue to cooperate with USDA while conducting ongoing oversight of the Animal Care inspection program. Since 1995, CAPS has been to approximately 1,000 commercial dog breeders and brokers, most of them federally licensed.
The USDA has been very negligent in its enforcement of AWA regulations with respect to commercial dog breeders and brokers. USDA APHIS/Animal Care uses inspectors, including veterinarians, to conduct "unannounced" inspections of federally licensed dog breeders and brokers who supply puppies to the pet shop industry.

SAN FRANCISCO (KGO) -- In San Francisco, where cats and dogs are officially called companions not pets, there is now a proposal to ban their sale.
The Animal Welfare Commission wants to prevent pet stores from selling dogs and cats, as well as smaller animals including hamsters, rats and chinchillas. Banning the sale of dogs and cats in the city is largely symbolic since few stores actually do, but they are selling the small animals and many eventually wind up at city shelters.

Event in Chicago Area Would have Featured Puppy Mill Dogs

The Chicago Tribune and The Daily Herald newspapers, which cover suburban Chicago, had ads for a "puppy expo" at the Veterans of Foreign Wars (VFW) lodge in Villa Park. Puppy mill owners -- A USDA licensed “B” dealer from Okahoma and a state licensed Missouri breeder -- were planning to transport their puppies to sell them at the expo on Saturday, February 13. This lodge held two puppy expos last year featuring the same breeders.
The Companion Animal Protection Society, The Puppy Mill Project, shelters and rescues across Illinois, Missouri and Iowa, and many more concerned citizens bombarded the VFW with phone calls and emails about how they were appalled that our Veterans would allow puppy mill dogs to be sold.
CAPS Chicago Campaign Coordinator Ida McCarthy educated VFW Commander in Charge Dennis Geiseman about puppy mills and inquired about interstate health certificates. Geiseman discovered the breeders did not have an Illinois license, which is necessary to sell more than five breeds of dogs. So, he refunded their money and cancelled the event. He stated "The VFW wants no part of puppy mills, ever...." The Villa Park lodge will no longer hold puppy expos.

CAPS protested Elite Animals for nearly six months. The store no longer sells animals although the owner told us that she might buy from California-based breeders (Southern California has a number of unlicensed puppy mills).

New York Attorney General Files Complaint Against Robin Schulder
The Office of the New York Attorney General filed a complaint in the Supreme Court of Nassau County on January 7, 2010 against Robin Schulder, an online puppy seller investigated by the Companion Animal Protection Society after CAPS received numerous consumer complaints. Schulder used fraudulent means to sell sick, deformed and dying puppies and refused to comply with the New York puppy lemon law. She shipped sick puppies as far away as California using connecting flights that took as long as 12 hours. She often wrote harassing, threatening emails to consumers who sought reimbursement for veterinary care or a refund. In an email to CAPS, she wrote disparaging comments about one of the CAPS complainants, even offering a donation to CAPS and claiming she belonged to a number of animal protection organizations and ran a nonprofit rescue organization. She told CAPS that she only bred a couple breeds of dogs that one couldn't obtain through rescues. Schulder who lives on a small lot in Queens, bred few if any dogs and obtained most of her puppies from other sources.

Update on USDA's Case Against Kathy Bauck: USDA Shuts Down Puppy Mill
Due to the efforts of the Companion Animal Protection Society, Kathy Bauck will no longer be able to sell to pet shops and other dog breeders and brokers. On August 13, 2009, the USDA/APHIS filed a Motion for Summary Judgment requesting the termination of Bauck’s license. It is rare for the agency to request the revocation of a license, especially through the expedited means of a summary judgment. CAPS believes the use of a summary judgment was due to the pressure APHIS felt from our petition for rulemaking. This petition requests that Animal Welfare regulations be amended to require the automatic revocation of a USDA license upon the conviction in a court of law of a licensee, such as Bauck, for animal cruelty.
On September 29, the administrative law judge issued a Decision and Order in the Bauck case, granting APHIS’ motion for summary judgment. On October 29, Bauck appealed that decision to the judicial officer. APHIS filed a response to her appeal on November 18. The judicial officer’s Decision and Order dated December 2 terminated Bauck’s license. Bauck can file a petition for reconsideration, but based on the strong language in the December 2nd decision, it is almost certain that USDA will deny the petition.

We have investigated the facility. Puppy Love Kennel (renamed CC Pets) was the focus of stories CAPS generated with “20/20,” and The Philadelphia Inquirer. CAPS gathered over a hundred consumer complaints, which resulted in the first settlement with the Office of the Attorney General. Stoltzfus was fined ,000. She continued to violate the laws and CAPS continued to receive complaints. The Attorney General reached another settlement, this time with a fine of ,000.

From December 2004 - June 2005, a CAPS investigator worked undercover at Hunte, the largest dog brokering facility in the country. Hunte uses employees and small brokers as booking agents who obtain puppies from mills throughout the Midwest and neighboring states and transport them to Hunte facilities. Hunte holds these puppies for several days before loading them on large semi trucks for trips to pet shops across the U.S. and Canada and to airports, where puppies are flown overseas to places such as Japan and South America. Hunte brokered puppies are sold at pet shops in Mexico and Puerto Rico. Petland, the largest pet shop franchise chain in the U.S., is a major Hunte customer. Andrew Hunte's daughter owns the largest Petland in the country.

Motion to Terminate Bauck's USDA License Granted; Bauck Appeals Decision
Due in part to the efforts of the Companion Animal Protection Society, Kathy Bauck may soon no longer be able to sell to pet shops and other dog breeders and brokers. On August 13, 2009, the USDA/APHIS filed a Motion for Summary Judgment requesting the termination of Bauck’s license. It is rare for the agency to request the revocation of a license, especially through the expedited means of a summary judgment. On September 29, the administrative law judge issued a decision and order in the Bauck case, granting APHIS’ motion for summary judgment. On October 29, Bauck appealed that decision to the judicial officer. APHIS filed a response to her appeal on November 18, and sometime thereafter the judicial officer will issue a decision on the appeal.

CAPS President Deborah, who has been interviewed on Animal Planet, CNN, CBS, NBC, ABC and FOX, is available for phone interviews. CAPS has done several stories with CBS 2 Chicago, including coverage of the Kathy Bauck investigation and criminal case. Bauck, who was one of the largest dog brokers and breeders in the country, was convicted of animal cruelty in March 2009 based on evidence from a six-week undercover employment investigation by CAPS. USDA issued a Decision and Order on December 2 that terminates Bauck’s license. Bauck sold to pet shops in the Chicago area.
WHAT: CAPS is protesting Happiness is Pets, which has six locations in the Chicago area, to draw awareness to the connection between pet shops and puppy mills. Almost all pet shops obtain dogs from puppy mills. Informing the public about the dangers of purchasing pet shop dogs is more important now than ever as people consider purchasing companion animals for gifts this holiday season.

CC Kennels in Lancaster County, PA
CC Kennels in Lancaster County, PA (formerly known as Puppy Love Kennels), owned and operated by Joyce Stoltzfus, has been closed down for six months and fined 6,000. CAPS has received many complaints over the years from customers who purchased sick and dying dogs from this kennel and conducted an undercover investigation of the facility. CAPS has also worked with the Pennsylvania Attorney General's Office on the two cases against Puppy Love.
